These Terms & Conditions (the “Terms”) govern your access to and use of XSIGI and any related websites, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1) The Service
- XSIGI provides tools for cryptographic operations, including generating and managing keys, creating signatures, verifying hashes, and producing audit-ready records.
- Documents are not permanently stored by XSIGI. Where temporary processing is required (e.g., to produce signatures or previews), files are processed transiently and discarded after completion.
- To enable later verification, XSIGI may retain minimal immutable evidence records such as document hashes, signature/public key identifiers, timestamps, and audit entries. These records do not contain your actual documents.
2) Account & Security
- You are responsible for safeguarding your account, authentication methods (including WebAuthn, passkeys, or 2FA), and private keys. Do not share credentials or recovery codes.
- You are responsible for activity that occurs under your account. Notify us promptly of any suspected unauthorized access.
- You are responsible for backing up your keys, documents, and outputs produced by the Service. XSIGI cannot recover private keys or files you do not retain.
3) Acceptable Use
- Do not use the Service to violate any law or third-party rights, including privacy, intellectual property, export, or sanction laws.
- Do not attempt to bypass security, probe or scan systems, or disrupt availability.
- Do not upload content that is unlawful, harmful, or that you do not have the right to process.
4) Electronic Signatures and Evidence
- XSIGI facilitates creation and verification of cryptographic signatures and integrity proofs. Legal enforceability of e-signatures and evidentiary value of hashes may vary by jurisdiction and context.
- XSIGI does not provide legal advice. You are responsible for ensuring that your use of signatures, seals, and records complies with applicable law and satisfies your business or regulatory requirements.
- We recommend preserving copies of original documents, signed artifacts, and the verification outputs (e.g., hash values and signature metadata) for your own records.
5) Data Retention and Deletion
XSIGI is designed to minimize data. We handle your data as follows:
- No permanent document storage: We do not keep your documents after processing. Temporary handling, when necessary, is ephemeral.
- Immutable evidence records: We retain limited non-content records (document hashes, signature hashes or key IDs, timestamps, and audit entries) for verification, fraud prevention, and legal compliance.
- Retention period: Evidence records are typically retained for 5–7 years, or as required by law, regulation, or contractual obligations.
- Deletion requests: You may request account deletion. A 30‑day cooling‑off window applies, during which you can cancel the request. After the window, your account data will be deleted. Immutable evidence records may be retained to the extent permitted or required by law and for verification purposes.
- Legal holds: If a legal hold applies, relevant records may be preserved beyond usual retention until the hold is lifted.

6) Intellectual Property
- We own all rights in the Service and its content, excluding your content. You retain rights to your content. You grant us the limited rights necessary to operate the Service (e.g., transient processing and display).
- Do not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law.
7) Third‑Party Services
The Service may integrate with third‑party services or libraries. Your use of those services is subject to their terms and privacy policies. We are not responsible for third‑party services.
8) Availability and Changes
- We may update, suspend, or discontinue parts of the Service at any time. We strive for high availability but do not guarantee uninterrupted service.
- Beta or experimental features may be offered “as is” and may change without notice.
9) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
- We do not warrant that the Service will meet your requirements, be error‑free, or that cryptographic evidence will be accepted by any particular court, regulator, or counterparty.
- You are solely responsible for compliance with your legal and regulatory obligations.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.
11) Indemnification
You agree to defend, indemnify, and hold harmless XSIGI and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to: (a) your content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third‑party rights.
12) Compliance, Export Controls, and Sanctions
You represent that you are not located in, under the control of, or a national or resident of any country or party subject to applicable trade sanctions or embargoes. You will comply with all export, re‑export, and sanctions laws applicable to your use of the Service.
13) Governing Law; Dispute Resolution
- These Terms are governed by the laws applicable at our principal place of business, without regard to conflict of laws rules.
- Any dispute will be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action or class‑wide arbitration. You and XSIGI agree to an exclusive venue at a competent court or arbitration forum where XSIGI is located for any matters not subject to arbitration.
14) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
